Kreskio Terms of Service
The rules for using Kreskio: creating an account, the trial, payments and the processing of data collected by the widget on your clients’ websites.
§ 1. General provisions
This is a translation for information. The Polish version of this document is binding.
The Kreskio service, available in the browser, as a widget embedded on websites and as a Chrome browser extension, is run by Marcin Maj, Słowiańska 24 43-180 Orzesze, e-mail: admin@kreskio.pl (hereinafter: the Service Provider). The Service Provider runs an unregistered business activity (działalność nierejestrowana) under Polish law.
Kreskio is used to collect reports of bugs and feedback on websites (screenshots, screen recordings, a description, technical data) and for a team’s work on those reports.
§ 2. Definitions
- User – a person who has created an account in Kreskio.
- Workspace – a separate space in Kreskio in which the User’s team collects reports. The owner of a Workspace is the User who created it (hereinafter: the Customer).
- Project – a website added to a Workspace on which the widget runs.
- Widget – the Kreskio script embedded by the Customer on a website, with a “Report a bug” button.
- Reporter – a person who sends a report through the widget without creating an account, e.g. a client or tester of the Customer.
- Extension – the Kreskio extension for the Chrome browser.
§ 3. Technical requirements
- An up-to-date web browser with JavaScript and cookies enabled.
- Screen recording works in the Chrome and Edge browsers on a computer.
- The Extension requires Chrome version 116 or later.
- Embedding the widget requires the ability to add code to the website.
§ 4. Account
- Creating an account requires providing a first name, an e-mail address and a password, and accepting the Terms of Service and the Privacy Policy.
- The User keeps the password confidential. The User may enable two-factor authentication (2FA) or passkeys.
- The Customer decides whom to invite to the Workspace and which role to give them, and is responsible for the actions of the people they have invited.
- Reporters do not create an account. They follow their reports through a link sent to the e-mail address they provided.
§ 5. Trial and payments
- A new Workspace may use Kreskio free of charge for 14 days (the trial), with the features of the Agency plan.
- Further use requires paying for one of the plans: Start – 49,00 zł per month or 490,00 zł per year; Agency – 119,00 zł per month or 1 190,00 zł per year. The prices are final prices. The plans differ in the limits described on the Kreskio website and in whether AI assistants may make changes to reports.
- When the plan is changed during a paid period, the remaining days are converted into days of the new plan of the same value, based on the monthly prices. A lower plan may be ordered when the number of projects, people and pages in the Workspace fits within its limits.
- Payment is made in advance, by bank transfer to the Service Provider’s bank account, on the basis of an order placed in Kreskio. The paid period starts when the payment is credited or at the end of the previous period.
- Once the payment has been credited, the Service Provider issues a bill and sends it to the e-mail address given in the order.
- The plan does not renew automatically. After the trial or paid period ends, the Workspace works in read-only mode: the team has access to the reports, but the widget and the Extension do not accept new ones.
- The Service Provider may grant selected Workspaces free access.
§ 6. Rules of use
- The Customer embeds the widget only on websites it has the right to, and informs their visitors that reports are collected, e.g. in the privacy policy of its website.
- Sending unlawful content, spam or malware through Kreskio, and attempting to circumvent security measures, are prohibited.
- The Service Provider may suspend a Workspace, disable the widget or delete reports if they are used in a way that breaches the Terms of Service, after first contacting the Customer, unless the urgent protection of other persons or of the Service requires otherwise.
§ 7. Personal data and entrustment of processing
The Service Provider processes Users’ data (account, order and bill data) as the controller – the details are described in the Privacy Policy.
The Service Provider processes the data collected by the widget and the Extension on the Customer’s websites (the Reporter’s name and e-mail, screenshots and screen recordings, the page address, technical browser data, console and network logs) on behalf of the Customer, who is their controller. By accepting the Terms of Service, the Customer entrusts the Service Provider with the processing of these data on the following terms (Art. 28 GDPR):
- The Service Provider processes the data solely to provide the Kreskio service and in accordance with the Customer’s documented instructions, which are the settings and actions in Kreskio.
- Persons with access to the data on the Service Provider’s side are obliged to keep it confidential.
- The Service Provider applies appropriate security measures: encrypted connections, files that are not publicly accessible, and masking of password and card data fields on screenshots.
- The Service Provider may use further processors (sub-processors: the server provider and the e-mail provider) listed in the Privacy Policy, and informs the Customer of planned changes, giving the Customer the opportunity to object.
- Making reports available to an AI tool that a User has connected with their own key (e.g. Claude Code, Cursor) is an instruction of the Customer. The provider of such a tool is not a sub-processor of the Service Provider. The Customer decides whether its team uses such tools and is responsible for choosing them.
- The Service Provider assists the Customer in fulfilling the rights of data subjects and in the obligations under Articles 32–36 GDPR, to the extent resulting from the nature of the service.
- The Service Provider notifies the Customer of a personal data breach without undue delay.
- After the agreement ends, the Service Provider deletes the Customer’s data, unless the law requires them to be stored.
- The Service Provider makes available to the Customer the information needed to demonstrate compliance with these obligations and allows audits on terms agreed with the Customer.
§ 8. Availability and liability
- The Service Provider makes every effort to keep Kreskio running without interruption, but may introduce technical breaks, announced in advance where possible.
- Towards Customers who are entrepreneurs, the Service Provider’s liability is limited to the amount paid by the Customer in the last 12 months and does not cover lost profits.
- The Customer is responsible for the content of the reports sent by its team and for the websites on which it embeds the widget.
§ 9. Complaints
Complaints about how Kreskio works may be submitted to admin@kreskio.pl. The Service Provider responds within 14 days.
§ 10. Termination of the agreement and deletion of data
- The User may delete their account at any time in the profile settings.
- The paid period is not refundable, unless the law provides otherwise or the Service Provider decides to grant a refund.
- After a Workspace or account is deleted, its reports, screenshots and recordings are deleted. Bills are stored for as long as the law requires.
§ 11. Changes to the Terms of Service
The Service Provider informs Users of changes to the Terms of Service by e-mail at least 14 days before they take effect. A User who does not accept the changes may delete their account before that date.
§ 12. Final provisions
- These Terms of Service are governed by Polish law.
- Kreskio is intended primarily for businesses. If the User is a consumer, the Terms of Service do not limit the rights granted to them by law.
- The Privacy Policy is an integral part of the Terms of Service.
